Shared fault

Massachusetts applies modified comparative fault with a 51% bar: an injured person whose fault is not greater than the defendants' combined fault still recovers, reduced proportionally, so an even 50/50 split still permits recovery.

Damage caps

Massachusetts places no cap on non-economic damages in ordinary injury cases. Its $500,000 malpractice cap does not apply where there is substantial or permanent loss of bodily function or substantial disfigurement — exceptions that serious burn cases commonly satisfy.
