How Massachusetts law treats vehicle fire injuries
Statutory research reviewed 2026-08-14. Not legal advice.
- Shared fault
- Massachusetts applies modified comparative fault with a 51% bar: an injured person whose fault is not greater than the defendants' combined fault still recovers, reduced proportionally, so an even 50/50 split still permits recovery.
- Mass. Gen. Laws ch. 231, § 85
- Damage caps
- Massachusetts places no cap on non-economic damages in ordinary injury cases. Its $500,000 malpractice cap does not apply where there is substantial or permanent loss of bodily function or substantial disfigurement — exceptions that serious burn cases commonly satisfy.
- Mass. Gen. Laws ch. 231, § 60H
- Claims against government
- Massachusetts allows two years to present a written claim to a public employer — a longer window than the notice deadlines most states impose.
- Mass. Gen. Laws ch. 258, § 4
Directory coverage for Massachusetts is expanding
We don’t have listings here yet — coverage grows state by state rather than all at once. Burn and fire cases are routinely handled across state lines, so attorneys listed elsewhere in the region may still be able to help.
