Alabama statute of limitations
2 years
for most personal-injury claims, per Ala. Code § 6-2-38(l).
Claims against government entities often carry shorter notice deadlines (often under six months). See our full state-by-state guide for citations and exceptions.
How Alabama law treats burn-injury claims
Shared fault
Alabama is one of a handful of states that still applies pure contributory negligence: if the injured person bears any share of the fault, however small, the claim is barred entirely.
Contributory negligence pleaded as an affirmative defense under Ala. R. Civ. P. 8(c)
Damage caps
Alabama caps neither ordinary personal-injury damages nor medical-malpractice damages. The state's $400,000 malpractice cap was struck down as unconstitutional and has not been replaced.
Moore v. Mobile Infirmary Ass'n, 592 So. 2d 156 (Ala. 1991)
Claims against government
A claim against an Alabama municipality must be filed within six months of the injury.
Ala. Code § 11-47-23
