How Florida law treats burn-injury claims

Shared fault

Florida switched from pure to modified comparative fault in 2023: an injured person who is more than 50% at fault now recovers nothing. The change turns on when suit is filed, while the shortened filing deadline turns on when the injury occurred — two different triggers from the same law.

Damage caps

Florida places no cap on non-economic damages in ordinary injury cases. The malpractice caps that remain in the statute books have been held unconstitutional and are unenforceable.
