How Nevada law treats chemical burns

Statutory research reviewed 2026-06-10. Not legal advice.

Shared fault
Nevada uses modified comparative negligence: an injured person can recover only if their share of fault is 50% or less (not greater than the defendants' combined fault), with the award reduced by their percentage.
NRS 41.141
Damage caps
Nevada has no cap on damages in ordinary negligence cases. Medical-malpractice non-economic damages are capped at $590,000 for 2026 injuries, rising $80,000 each January 1 until reaching $750,000 in 2028, then adjusting 2.1% annually.
NRS 41A.035 (as amended by AB 404, 2023)
Claims against government
Claims against the State of Nevada are filed with the Attorney General, and claims against cities or counties with their governing body, within two years — and the ordinary two-year personal-injury deadline still applies to filing suit.
NRS 41.036
Punitive damages
Punitive damages require clear and convincing evidence of oppression, fraud, or malice, and are capped at three times compensatory damages (or $300,000 in smaller cases) — but there is no cap when the harm comes from a defective product, among other exceptions.
NRS 42.005
