How Nevada law treats vehicle fire injuries
Statutory research reviewed 2026-09-29. Not legal advice.
- Shared fault
- Nevada uses modified comparative negligence: an injured person can recover only if their share of fault is 50% or less (not greater than the defendants' combined fault), with the award reduced by their percentage.
- NRS 41.141
- Damage caps
- Nevada has no cap on damages in ordinary negligence cases against private parties. Tort awards against the State of Nevada, a city, county or other political subdivision, or a public employee acting within the scope of employment are capped at $200,000 per claimant. Medical-malpractice non-economic damages are capped at $590,000 for 2026, rising $80,000 each January 1 until reaching $750,000 in 2028, then adjusting 2.1% annually.
- NRS 41.035; NRS 41A.035 (as amended by AB 404, 2023)
- Claims against government
- Claims against the State of Nevada are filed with the Attorney General, and claims against cities or counties with their governing body, within two years — and the ordinary two-year personal-injury deadline still applies to filing suit.
- NRS 41.036
- Punitive damages
- Punitive damages require clear and convincing evidence of oppression, fraud, or malice, and are capped at three times compensatory damages (or $300,000 in smaller cases) — but there is no cap when the harm comes from a defective product, among other exceptions.
- NRS 42.005
