- Ohio is one of the few states that caps non-economic damages in ordinary injury cases: the greater of $250,000 or three times economic damages, up to $350,000 per plaintiff. The cap does not apply at all to permanent substantial physical deformity or to injuries preventing independent self-care — categories severe burn injuries frequently fall into.
