Idaho applies modified comparative fault with a 50% bar: recovery is lost once the injured person's fault equals or exceeds the defendant's.

Idaho caps non-economic damages in ordinary injury cases, not just malpractice. The figure is re-indexed to wage inflation every July 1 and stands at $538,425.04 as of July 1, 2026. The cap does not apply to willful or reckless misconduct.
