How Idaho law treats house fire injuries

Statutory research reviewed 2026-08-14. Not legal advice.

Shared fault
Idaho applies modified comparative fault with a 50% bar: recovery is lost once the injured person's fault equals or exceeds the defendant's.
Idaho Code § 6-801
Damage caps
Idaho caps non-economic damages in ordinary injury cases, not just malpractice. The figure is re-indexed to wage inflation every July 1 and stands at $538,425.04 as of July 1, 2026. The cap does not apply to willful or reckless misconduct.
Idaho Code § 6-1603 (adjusted under § 72-409(2))
Claims against government
Idaho requires notice of a tort claim within 180 days — filed with the Secretary of State for claims against the State, or with the clerk for a city or county. This runs separately from, and expires long before, the two-year filing deadline.
Idaho Code §§ 6-905, 6-906
