Colorado follows modified comparative negligence: an injured person can recover only if their share of fault is less than 50%, and the award is reduced by their fault percentage.

Damage caps
For most negligence claims accruing on or after January 1, 2025, non-economic damages (pain and suffering) are capped at $1.5 million — raised from roughly $642,000 by HB24-1472 — with inflation adjustment beginning in 2028. Economic damages such as medical bills and lost income are not capped. Medical-malpractice and government-entity claims have separate, lower caps.

Claims against government
Before suing a Colorado public entity (a city, county, school district, or the state), a written notice of claim must be filed within 182 days of discovering the injury; missing that deadline bars the claim.
