Shared fault
New Mexico follows pure comparative negligence: damages are reduced by the injured person's share of fault, never barred by it.
Scott v. Rizzo, 96 N.M. 682 (1981)
Damage caps
New Mexico places no cap on damages in ordinary injury cases against private defendants. Caps apply only to medical malpractice and to claims against government entities.
N.M. Stat. Ann. §§ 41-5-6, 41-4-19
Claims against government
New Mexico requires notice within 90 days of the incident, extended to six months for wrongful-death claims. The requirement is waived where the entity already had actual notice.
N.M. Stat. Ann. § 41-4-16
