How Louisiana law treats scald burns

Statutory research reviewed 2026-06-10. Not legal advice.

Shared fault
Louisiana's rule changed on January 1, 2026: for injuries on or after that date, a person 51% or more at fault recovers nothing (modified comparative fault). For earlier injuries, the old pure comparative rule applies — fault reduces the award but never bars recovery.
La. Civ. Code art. 2323, as amended by 2025 La. Acts (HB 431)
Damage caps
Louisiana has no cap on damages in ordinary negligence cases. Medical-malpractice recovery against qualified providers is capped at $500,000 total (excluding future medical care).
La. R.S. 40:1231.2(B)(1)
Claims against government
Louisiana has no special pre-suit notice requirement for claims against the state or local governments — the ordinary filing deadline applies (two years for injuries on or after July 1, 2024) — but general damages against a government entity are capped at $500,000 per person.
La. R.S. 13:5106(B)(1); La. Civ. Code art. 3493.1
Punitive damages
Louisiana generally does not allow punitive damages unless a specific statute authorizes them; the main exception relevant to injury cases is harm caused by an intoxicated driver's wanton or reckless conduct.
La. Civ. Code art. 2315.4
