How Iowa law treats scald burns
Statutory research reviewed 2026-08-14. Not legal advice.
- Shared fault
- Iowa applies modified comparative fault with a 51% bar: an injured person who is 50% or less at fault still recovers, reduced proportionally.
- Iowa Code § 668.3(1)(a)
- Damage caps
- Iowa places no cap on non-economic damages in ordinary injury cases. Its malpractice caps do not apply at all where the injury involves substantial or permanent impairment, disfigurement, or death.
- Iowa Code § 147.136A
- Claims against government
- Iowa sets no shortened notice deadline for claims against a city or the State — both run on the same two-year period as an ordinary injury claim. Sources still describing a 60-day municipal notice rule are out of date; it was repealed in 2007.
- Iowa Code §§ 670.5, 669.13
