How Georgia law treats explosion injuries
Statutory research reviewed 2026-06-10. Not legal advice.
- Shared fault
- Georgia uses modified comparative negligence with a 50% bar: damages are reduced by the injured person's share of fault, and a person 50% or more responsible recovers nothing.
- O.C.G.A. § 51-12-33
- Damage caps
- Georgia has no cap on non-economic damages in negligence cases — the Georgia Supreme Court struck down the prior cap in 2010 as violating the jury-trial right. The 2025 tort-reform law (SB 68) changed how damages may be argued at trial but imposed no cap.
- Atlanta Oculoplastic Surgery v. Nestlehutt, 286 Ga. 731 (2010)
- Claims against government
- Georgia's pre-suit notice deadlines differ by defendant: six months for claims against a city, twelve months for a county, and twelve months for the state under the Georgia Tort Claims Act. City notices carry strict content requirements and are a common claim-killer.
- O.C.G.A. §§ 36-33-5, 36-11-1, 50-21-26
- Punitive damages
- Punitive damages are generally capped at $250,000 on clear and convincing evidence of willful misconduct or malice — but the cap does not apply in product-liability cases (where 75% of the award goes to the state treasury), or where the defendant intended harm or was the impaired driver or actor.
- O.C.G.A. § 51-12-5.1
